By accessing the Website or by checking the “I Agree” box during the account registration process, you (“you,” “your,” or “the User”) agree to be bound by these Terms and our Privacy Policy. 1. Nature of the Service and Educational Exemption
Hopelactation.ca provides digital education courses, resources, and community forums related to infant feeding, lactation, and parenting.
1.1 Personal Use Only: You acknowledge that the courses provided on this Website are “personal interest or hobby courses” designed solely to provide general education and support to parents and caregivers.
1.2 Not Vocational Training: This Website does not provide postsecondary training intended to prepare you for employment in a specific profession. Our courses are not vocational programs, and this Website is not registered as a private career college under the Ontario Career Colleges Act, 2005. Completion of our courses does not confer any professional accreditation, diploma, or certification to practice as a lactation professional.
2. Medical Disclaimer – No Medical Advice
2.1 Educational Purposes Only: All content provided on the Website, including but not limited to text, graphics, videos, course materials, forum posts, and communications with instructors (the “Content”), is provided for general educational and informational purposes only.
2.2 No Healthcare Relationship: Accessing the Website, viewing the Content, or communicating with our educators does not create a physician-patient, nurse-patient, or clinician-client relationship.

3. Account Registration and Security
To access our courses via our Learning Management System, you must register for an account.
3.1 Accurate Information: You agree to provide accurate, current, and complete information during the registration process. You warrant that you are at least 18 years of age and possess the legal capacity to form a binding contract.
3.2 Credential Sharing Prohibited: Your account is for your individual use only. You are strictly prohibited from sharing your login credentials (username and password) with any other person. Our platform utilizes concurrent login protection software; attempting to log in from multiple devices simultaneously or sharing your credentials constitutes a material breach of these Terms and will result in the immediate termination of your account without a refund.
3.3 Account Security: You are entirely responsible for maintaining the confidentiality of your password and for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Intellectual Property and Limited License
4.1 Ownership: All Content, course materials, videos, text, logos, and website design are the exclusive property of or its licensors and are protected by Canadian and international copyright, trademark, and intellectual property laws.
4.2 Limited License: Upon purchase of a course, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and view the course Content strictly for your personal, non-commercial use.
4.3 Prohibited Conduct: You explicitly agree that you will not:
- Copy, reproduce, modify, create derivative works from, or distribute any Content from the Website.

Consequently, you are strictly prohibited from using the Website, its forums, or any communication tools to advertise, market, promote, or idealize breast-milk substitutes (infant formula), feeding bottles, or artificial nipples. You may not post promotional coupons or links to formula manufacturing companies.
5.2 Acceptable Use: You agree not to post any content that is defamatory, libelous, offensive, indecent, harassing, or that invades the privacy or infringes upon the intellectual property rights of others.
5.3 Right of Removal: We do not pre-screen user comments, but we reserve the absolute right, in our sole discretion, to monitor, edit, or remove any user content that violates these Terms, the WHO Code, or that we deem inappropriate, without prior notice.
5.4 License to User Content: By posting comments or feedback on the Website, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and publish that content in connection with the operation of the Website.
6. Payment, Pricing, and Refund Policy
The following terms apply to all purchases made through the Website, constituting an Internet Agreement under the Ontario Consumer Protection Act, 2002.
6.1 Pricing: All prices listed on the Website are in Canadian Dollars (CAD). Applicable provincial and federal taxes will be calculated and added at checkout. We reserve the right to change our prices at any time.
6.2 Digital Delivery: Upon successful processing of your payment, access to the digital course materials is granted immediately via your user dashboard.
6.3 Refund Policy: Due to the immediate, consumable, and digital nature of the educational courses, all sales are final. We generally do not offer refunds, returns, or exchanges once a purchase is completed. However, if you have purchased a course in error and have not yet logged in, accessed, or viewed any course materials, you may request a refund by contacting us within 48 hours of purchase. Refund requests are evaluated based on backend system logs and are granted at our sole and absolute discretion.
7. Privacy and Data Collection
Your privacy is important to us. Our data collection and use practices are governed by the Personal Information Protection and Electronic Documents Act (PIPEDA). You hereby explicitly consent and submit to the exclusive jurisdiction of the courts located in the Province of Ontario for the resolution of any dispute, proceeding, or legal action related to this Agreement or your use of the Website.
11. Amendments to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect, utilizing a banner on the Website or an email notification. Your continued use of the Website following the posting of any changes constitutes acceptance of those changes in good faith.
